1. Agreement to Terms

By accessing or using SEOBuilder at seobuilder.tech ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

SEOBuilder is an AI-powered SEO platform that provides:

• Keyword research and tracking
• Website rank monitoring
• Technical SEO site audits
• Content optimization tools
• Backlink analysis
• Competitor intelligence
• Integration with Google Search Console and Google Analytics
• AI-powered SEO recommendations

The Service is provided on a subscription basis with different tiers: Free (Starter), Pro, and Lifetime.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.

You are responsible for:

• Safeguarding the password used to access the Service
• Any activities or actions under your account
• Notifying us immediately of any unauthorized use

You must be at least 18 years old to use this Service. By using SEOBuilder, you represent and warrant that you meet this age requirement.

4. Subscription and Billing

4.1 Free Plan

The Free plan provides limited access to features at no cost. No credit card is required. Free plan usage is subject to fair use limits.

4.2 Pro Plan

The Pro plan is a paid subscription billed monthly or annually. Your subscription will automatically renew unless cancelled. You may cancel at any time, and cancellation will take effect at the end of the current billing period. No refunds will be provided for partial billing periods.

4.3 Lifetime Plan

The Lifetime plan is a one-time payment for permanent access to Pro features. No recurring charges apply. Lifetime access is subject to the continued operation of the Service.

4.4 Payment Processing

All payments are processed securely through Stripe. By subscribing, you agree to Stripe's terms of service. We do not store your full credit card information.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to any portion of the Service or its systems
• Interfere with or disrupt the Service, servers, or networks
• Scrape, data mine, or extract data from the Service beyond normal usage
• Resell, redistribute, or sublicense the Service without authorization
• Use the Service to send spam, phishing, or unsolicited communications
• Upload malware, viruses, or other harmful code
• Impersonate any person or entity
• Use automated systems (bots, crawlers) to access the Service without permission
• Circumvent any rate limits or usage restrictions

7. Intellectual Property

The Service and its original content, features, and functionality are owned by SEOBuilder and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you create using our tools. By using the Service, you grant us a limited license to process your content as necessary to provide the Service.

8. Data and Privacy

Your use of SEOBuilder is governed by our Privacy Policy, which describes how we collect, use, and protect your information, including data from connected Google services.

By using the Service, you consent to the collection and use of information as detailed in our Privacy Policy.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide advance notice when possible)
• Unscheduled emergency maintenance
• Third-party service outages (Google, payment providers, etc.)
• Events beyond our reasonable control

10. Limitation of Liability

To the maximum extent permitted by law, SEOBuilder and its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of profits, revenue, or data
• Loss of goodwill or reputation
• Cost of substitute services
• Any other intangible losses

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The SEO data provided will be accurate or reliable
• Any defects in the Service will be corrected

12. Indemnification

You agree to indemnify, defend, and hold harmless SEOBuilder and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of and access to the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you submit or create through the Service

13. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and data in accordance with our Privacy Policy
• All provisions of these Terms that should survive termination will survive

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
